Accounts

Account creation is required to complete a sell order transaction. We suggest you use your email address as your sign on. If purchases are allowed, it is not necessary to register to purchase products from this web site. You, the seller, agree to provide Texas Book Company with accurate identifying information including full legal names of individuals (no aliases), correct company name (if a business), correct physical address (no p.o. boxes), correct email address, and correct telephone numbers. You agree to keep this information updated in your account and to verify or correct it when completing a transaction. Texas Book Company reserves the right to terminate accounts if fraudulent information is provided, if duplicate accounts are found, or if any terms are violated.

Newsletter

Our users are given the opportunity to 'opt-out' of receiving our newsletter or promotional materials at the point where we ask for the information. Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by following the unsubscribe link in the email message.

Privacy

If we decide to change our privacy policy, we will prominently post those changes on our web site so our users are always aware of what information we collect, how we use it, and the circumstances, if any, under which we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we would notify users by way of an email. Condition

For the purposes of selling books to Texas Book Company, a new condition textbook is a textbook that is identical to the quality a publisher would sell to a bookstore. There is no writing, no bent corners, no highlighting, no smudges, no "complementary copy" stamp, no "free copy" stamp, or any other alternate publisher markings on or inside the textbook. In addition, time of possession has no bearing as to determination of new condition. "New" textbook condition is defined as a textbook that meets these requirements when it arrives at our facility.

Textbooks that have markings that reflect Annotated, Annotated Instructor's Edition, Free Copy, Complimentary Copy, NOT FOR RESALE, Exam, Review, etc. are considered Instructor's Editions only. Visit our book condition section to verify the appropriate category for your text.

To help ensure you receive new condition value for anticipated new books, it is your responsibility to pack your books in a new heavy duty, sturdy shipping box (no reused boxes or envelopes) with ample packing material and thoroughly seal it with shipping tape. The shipping process is rough on heavy objects packed in cardboard boxes. We strongly encourage you to carefully follow the guidelines set for in the Shipping Instructions.

Condition of the textbook is graded when the book arrives in our facility, not the condition of the book when it was shipped. It is your responsibility to pack your anticipated new condition books in a manner to survive the shipping process in new condition. No bending of any part of the binding (especially corners) or book itself, no scratches or abrasions on the cover and no imprinted marks installed by the publisher on or inside the cover are allowed under the new condition requirements.
 

Seller Warranty

You, the seller, represent and warrant to Texas Book Company with an address of 8501 Technology Circle, Greenville, Texas USA (“Buyer”) that you have full, marketability and legal title and ownership of all textbooks being sold to Buyer, that all textbooks being sold to Buyer are authentic and lawfully acquired, that you have the right and authority to transfer such title and ownership to Buyer, that the textbooks being sold were not intended to be destroyed by previous owners, and that the sale and delivery of such textbooks to Buyer for the purpose of resale to others in the United States or elsewhere will not violate any law, rule, regulation, indenture, instrument, agreement, or contract. You also confirm that you have not misrepresented yourself to any of your books suppliers. Additionally, you will not sell or deliver to Buyer any textbooks which are rebound, or damaged beyond normal usage, or marked and identified as “International Student Editions” (ISE’s). You also understand and agree that Texas Book Company has the right to decline the purchase of any textbook offered pursuant to these terms and to contact authorities in the case of a violation or suspected violation of a law. You as an individual and in your capacity as an agent for your company (if applicable) agree to indemnify and hold harmless Buyer and its directors, officers, owners, agents, insurers, employees, affiliates, and customers from any claims by third parties or expenses (including attorneys’ fees and costs through trials and appeals levels) arising from any misrepresentation. In the event of a dispute, you agree to submit to the jurisdiction and venue of the state and federal courts in Hunt County, Texas. You further agree that any dispute will be governed by Texas law.

Returns

All shipments become the property of Texas Book Company upon their arrival. There will not be any return of merchandise.

Counterfeits

Counterfeiting textbooks is a violation of the law which harms the copyright owner, and deprives authors and publishers of compensation for their work. Counterfeits books are also inferior and harm students. Texas Book Company has strong anti-counterfeiting practices and we support enforcement efforts to identify and pursue counterfeiters. To help support anti-counterfeiting practices, upon request you agree to provide information (individual/business name, physical address) on the source of books you sell to Texas Book Company.

Our examination staff has received thorough training in counterfeit identification and we maintain an extensive library of publisher exemplars. You understand and agree that Texas Book Company reserves the right to inspect for authenticity all products received for possible counterfeit or otherwise illegally published goods, and to delay payment while shipments are inspected. Copies not found to be counterfeit will be paid for promptly. Copies found to be counterfeit will not be paid for and Texas Book Company will have the right to send on to the publisher and cooperate with enforcement efforts. Cooperation includes providing sellers account information and selling history to appropriate authorities. Authorities may include publishers or their agents, industry watchdog groups, or law enforcement officials.
